All orders placed on this site are subject to the general conditions of sale presented below.

1. ACCEPTANCE OF CONDITIONS
The customer declares to have read the provisions of these general conditions of sale before ordering the artwork. By placing the order, the customer expressly and irrevocably accepts the terms set out below.

2. ARTWORKS 

The artworks sold by the site are identified by one or more photos, a descriptive text and a price including tax in euros. Miriam Salamander strives to best present and describes the essential characteristics of the products presented. However, the perception of colors being subjective, the visuals are not contractual and Miriam Salamander cannot be held responsible for the difference in color nuances. 3. ORDERS
The sale will not be concluded until payment of the order. The information stated by the buyer, when taking the order commits it: in case of an error in the wording of the recipient’s contact details, the seller cannot be held responsible for the impossibility in which it could be to deliver the product.

4. DELIVERIES
After confirming the order, Miriam Salamander agrees to dispatch all the references ordered by the buyer, and this, within 7 working days. This deadline can be given for information by email. Delivery times are always given as an indication. Exceeding them cannot justify the cancellation of your order without our prior agreement. The buyer is delivered to his home. In case of absence, the purchaser or the recipient of the ordered artwork receives a transit advice note from the carrier, which allows him to collect the ordered artwork, at the nearest post office, for a period of fifteen days. The buyer is required to check, in the presence of the delivery person, the condition of the packaging of the goods and its content on delivery. In the event that the purchaser has any doubt of any kind whatsoever on the condition or content of his package, he is required to report the damage noted, to note any complaints and reservations or to refuse the goods in immediately issuing an anomaly report to the carrier and to report these incidents to the seller within 48 hours. The seller cannot be held responsible for lost packages.

5. PROBLEMS OF QUALITY OR CONFORMITY
In the event of delivery of a artwork that does not correspond to the order (defective or non-compliant), the buyer must formulate his complaint within 48 hours from the date of receipt of the package. Complaints must be sent by email to mail@miriamsalamander.com
They must include:
– buyer’s contact details
– product references
– the reasons for the complaint.
The return of artwork must be made within fourteen working days from the allocation of a return number by Miriam Salamander customer service. Any product to be exchanged or reimbursed must be returned as it was shipped, in its original condition and packaging and include the entire product. The costs of the initial shipment will be reimbursed to the buyer. Return shipping costs are the responsibility of the buyer.

Following a complaint, after receipt of the product and validation of its non-compliance by Miriam Salamander, the customer may request:
* Or to be delivered with a product identical to that ordered, within the limits of available stocks. The costs of returning the ordered and delivered artwork will be borne by the buyer, the delivery costs of another artwork will be borne by Miriam Salamander.
* Or be reimbursed for the price of the Artwork ordered within 30 days of the customer’s request. The absence of complaints on the part of the customer means that the delivered item is deemed satisfactory and cannot be the subject of any subsequent dispute.

In any event, these provisions do not deprive the customer of the benefit of his right of withdrawal, as framed by article 6 of these General Conditions of Sale.

6. RIGHT OF WITHDRAWAL
In accordance with article L 121-16 of the Consumer Code, the buyer has a period of fourteen clear days from the date of receipt of the articles to return, at his expense, the artwork ordered for reimbursement. The artwork must imperatively be returned in perfect condition for resale, in their original state, duly sealed and accompanied by the invoice corresponding to the purchase. Any incomplete, damaged, damaged product or whose original packaging has been damaged, will not be refunded or exchanged. The purchaser is advised to use a carrier offering tracking and insurance of the returned goods. In the event that it is lost or damaged in transport, Miriam Salamander cannot reimburse the purchaser, who must make a claim directly with the carrier. In case of exercise of the right of withdrawal, only the price of the product (s) purchased will be refunded. Shipping and return costs are the responsibility of the Buyer.

7. AVAILABILITY OF PRODUCTS
If the ordered artwork is unavailable, Miriam Salamander will inform the buyer as soon as possible. The buyer will be reimbursed without delay and at the latest within thirty days of payment of the sums he has paid.

8. PRICE
The price is expressed in euros and does not include shipping costs. The price indicated in the order confirmation is the final price, expressed all taxes included without VAT (article 293B of the tax code) for Germany and the countries of the EEC. Shipping costs are the responsibility of the customer, unless otherwise stated or conditions. Payment: Payments are made online through PAYPAL or a direct bank transfer and are completely secure thanks to these payment platforms. The price invoiced to the customer is the price indicated on the order confirmation sent by Miriam Salamander. The price of the artwork is payable in cash on the day of the actual order. Payment is made by bank transfer. Furthermore, Miriam Salamander reserves the right to refuse any order from a customer.

9. RESPONSIBILITIES
Under no circumstances may Miriam Salamander be held liable for improper use or deterioration linked to exceptional weather conditions. Miriam Salamander cannot be held liable for damages of any kind, whether tangible or intangible, which may result from a malfunction or improper use of the products sold. Complaints or disputes will always be received with attentive benevolence, good faith is always presumed in those who take the trouble to explain their situations. In the event of a dispute, the customer will contact Miriam Salamander to obtain an amicable solution.

10. PERSONAL INFORMATION
Miriam Salamander undertakes to respect the confidentiality of personal data communicated by the client on the Site and to treat it in compliance with the Data Protection Act of January 6, 1978. The client has a right of access to information concerning him. Upon request, they can be communicated to it and, in the event of an error or modification, be rectified. The customer’s personal data will not be communicated to third parties unless explicitly requested.

11. MODIFICATIONS TO THE GENERAL SALES CONDITIONS
Miriam Salamander reserves the right to modify these General Conditions of Sale.

12. DISPUTES
Any dispute to which these general conditions of sale may give rise must be brought before the Caen tribunal de grande instance.
